Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employeesin that employees were exposed to: The hazard of fire, explosion or the catastrophic release of toxic material at the Stone Container Corporation Frenchtown facility. Among other methods, feasible and acceptable abatement methods to correct this hazard is to implement and enforce an effective chemical process safety program. An example of such a program is contained in the Guidelines for Technical Management of Chemical Process Safety recommended by the Center for Chemical Process Safety of the American Institute of Chemical Engineers.
