29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. a. Located in the Quonset hut at Rhodes Manufacturing, employees perform welding and metal grinding operations on tank bottoms that were resting on a Toyota forklift's elevated forks while there was no operator at the forklift's controls, thereby exposing the employees to a struck-by and/or caught-between hazard. b.
