29 CFR 1926.1427(b)(4)(i): While operating the equipment, the employer did not ensure operator-in-training was continuously monitored by an individual ("operator's trainer") who meets all of the following requirements: (A) The operator's trainer is an employee or agent of the operator-in-training's employer. (B) The operator's trainer has the knowledge, training, and experience necessary to direct the operator-in-training on the equipment in use: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer did not ensure that an unlicensed/uncertified crane operator-in-training was continuously monitored by a fully qualified/certified trainer while operating the Liebherr 550 HC40, 20-ton tower crane. This condition exposed employees and subcontracted employees to fall and struck-by hazards.
