29 CFR 1926.1427(b)(3)(ii): The employer did not prevent the operator-in-training from using the equipment to hoist personnel: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer did not ensure subcontracted employees were protected from fall and struck-by hazards in that an unlicensed/uncertified crane operator-in-training was allowed to operate the Liebherr 550 HC40, 20-ton tower crane to hoist personnel on a Doka working platform. This condition exposed subcontracted employees to falls and struck-by hazards.
