29 CFR 1926.1427(b)(3): The employer assigned tasks which were not within the operator-in-training's ability: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer assigned tasks and allowed the operator-in-training that was not certified/qualified to operate the Liebherr 550 HC40, 20-ton tower crane to perform tasks involving the use of equipment that were outside the operator-in-trainings ability. This condition exposed employees and subcontracted employees to struck-by hazards.
