29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface: The employer does not ensure the top edge height of top rails, or equivalent guardrail system members are 42 inches plus or minus 3 inches above the walking and working surface. a) This violation was observed on or about June 4, 2019 at the maintenance building, guardrails for the spiral staircase opening were less than 39 inches from the walking-working surface. b) This violation was observed on or about June 3, 2019, at the Renegade Rapids ride, the guardrails were less than 39 inches from the walking-working surfacel. Pursuant to 29 CFR 1903.19, within (10) calendar days of the date of this citation, the employer must submit documentation describing the steps taken to ensure all guardrails are at least 42 inches in height, plus or minus 3 inches.
