29 CFR 1926.62(d)(2)(v)(B): Until the employer performed an employee exposure assessment as required under 29 CFR 1926.62(d) and determined actual employee exposure, the employer did not provide employees performing the tasks described in 29 CFR 1926.62(d)(2)(i), (d)(2)(ii), (d)(2)(iii), and (d)(2)(iv) with appropriate personal protective clothing and equipment in accordance with paragraph (g): On or about October 10, 2017, employees working at Building 62 of the Rock Island Arsenal, in the absence of an employee exposure assessment, the employer did not provide the employees exposed to lead with personal protective clothing and equipment and employees: a) disturbed heavily deteriorated window paint containing 30-percent lead with an Arbortech AS170 Brick and Mortar Saw used within 2-inches of the failed paint; b) disturbed heavily deteriorated window paint containing 30-percent lead with a Bosch Rotary Hammer Bulldog Extreme used within 2-inches of the failed paint; c) dry swept and scooped mortar debris containing 0.23-percent lead from the window sills and into 5-gallon buckets; and d) deposited paint and mortar debris from 5-gallon buckets into a waste pile containing 0.018-percent lead.
