29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder: a) 30 Wilson Avenue, New Square, NY: On or about 5/31/23, an extension ladder being used by employees to access the roof level was not secured nor barricaded when an excavator was in use in the area along with other vehicles. b) 50 Wilson Avenue, New Square, NY: On or about 6/7/23, an extension ladder being used by an employee to access a 3rd floor wall opening was not secured nor barricaded when an excavator was in use in the area. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
