29 CFR 1926.1427(b)(1): The employer did not provide instruction on the knowledge and skills listed in paragraphs (j)(1) and (2) of this section to the operator-in-training: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer did not provide the operator-in-training of the Liebherr 550 HC40, 20-ton tower crane instruction, knowledge, skills, or the information necessary for safe operation of the tower crane through a written test and a determination through a practical test that the individual has the skills necessary to safely operate the tower crane. This condition exposed employees and subcontracted employees to crushing and struck-by hazards.
