29 CFR 1910.1025(j)(1)(i): The employer did not institute a medical surveillance program for all employees who are or may be exposed at or above the action level for more than 30 days per year: On or about July 31, 2023, the employer failed to establish a medical surveillance program for all employees who are or may be exposed to lead at or above the action level of 30 micrograms per cubic meter of air for more than 30 days per year. a) On July 31, 2023, an employee tasked with performing cleaning and maintenance duties on lead contaminated machines was exposed to an 8-hour time weighted average of 61.8 micrograms per cubic meter (�g/m^3) for lead, approximately 1.2 times the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter (�g/m^3). The exposure level was derived from a sample collected over a 382 minute sampling period, with zero exposure assumed for the remaining 98 minutes.
