29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, items (3)(i) through (3)(vi) of this paragraph: (a)CJ TMI Manufacturing America, LLC, waste water pit: The employer did not develop and implement the means, procedures and practices necessary for safe entry into the waste water pit including, but not limited to, acceptable air quality parameters, procedures to eliminate slip and fall hazards, determine the frequency of air monitoring when in the waste water pit to determine acceptable atmospheric conditions and for the use of ventilation to control atmospheric hazards within the waste water pit prior to and during entry, on or about 11/24/2021. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
