29 CFR 1910.146(d)(3)(iv): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, purging, inerting, flushing, or ventilating the permit space as necessary to eliminate or control atmospheric hazards: a) In the North Shop, on or about July 20, 2017 - The employer failed to ventilate the high pressure tank car TILX 303142 to eliminate an oxygen depleted atmosphere and permit safe entry for a tank welder entering the tank to set up for a post weld heat test as well as two employees entering the tank to rescue the tank welder.
