Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries/death due to the personnel platform, for the 12 ton Mobile Hydraulic Crane, not being proof tested to 125 percent of the platforms rated capacity. a. Among other methods, one feasible and acceptable abatement method to correct this hazard is to test to 125 percent of the platforms rated capacity by holding it in a suspended position for five minutes as required by the Construction Standards 1926.550(g)5)(vi).
