Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of being struck or crushed by the hoisted load and the crane body/boom of the 80 ton Link Belt Lattice Boom Crawler Crane Model Number LS - 138 II Serial Number H7J1-5924 when this crane was operated out-of-level due to inadequate ground support for the machine and load. a) Among other methods, one feasible method and acceptable abatement to correct this hazard is to ensure that firm footing, uniformly level within one percent is provided. Where such footing is not otherwise supplied, it should be provided by substantial timbers, cribbing, or other structural members sufficient to distribute the load so as not to exceed the safe bearing capacity of the underlying material in accordance with section 5-3.4.6 of the American National Standards Institute (ANSI) B30.5-1968, Crawler, Locomotive and Truck Cranes.
