29 CFR 1910.146(d)(5)(ii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing or monitoring the permit space as necessary. On or about March 14, 2024, and times prior thereto, the employer entered and or broke the plane of entry at frac tanks and vacuum truck tanks to conducted cleaning operations, the employer did not evaluate permit space conditions during entry operations by testing or monitoring the frac tanks and vacuum truck tanks as necessary.
