29 CFR 1910.1450(d)(1): The employer did not measure the laboratory employee's exposure to a substance regulated by a standard which required monitoring when there was reason to believe that exposure levels for that substance routinely exceeded the action level or in the absence of an action level, the permissible exposure limit. a) Hau Processing Labs: On April 18, 2024, and at times prior, employees were exposed to Methylene Chloride for a sampling duration of 15-minutes short-term exposure of 148 parts per million, approximately 23 parts per million above the Short-term exposure limit of 125 parts per million. Sampling accounted for the full 15 minutes. The employer failed to perform the required monitoring when there was reason to believe that exposure levels exceeded the Short-Term Exposure Limit.
