29 CFR 1926.1427(a)(1): An employee who has not been certified/licensed and evaluated to operate assigned equipment in accordance with this section, operated the equipment as an operator-in-training not under supervision: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer allowed the operation of the Liebherr 550 HC40, 20-ton tower crane by an operator that was not certified/licensed or evaluated to operate the tower crane. The operator-in-training was allowed to operate tower crane without supervision. This condition exposed employees and subcontractor employees to crushing and struck-by hazards.
