29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was required to use the respirator in the workplace: a) Shop: On or about September 17, 2021, and continuing thereafter, employees were required to remove collected dust from dust collectors and required to wear respirators elastomeric N95 respirators to protect against dust. The employer did not provide medical evaluations to these employees before they were required to use the respirators. b) Shop: On or about March 2, 2022, the employer required an employee to wear N95 filtering facepeice respirator to protect against organic vapors when the employee applied spray adhesive to flakeboard. The employer did not provide a medical evaluation to the employee before he was required to use the respirator.
