29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Key Structures, LLC.: On or about September 10, 2020, and at times prior, employees were exposed to respiratory hazards from chemicals such as, but not limited to; Titanium Dioxide, Propanoic Acid, Zinc Oxide, and Diuron (CORONADO SUPER KOTE 5000 EXTERIOR ACRYLIC SATIN), and Titanium Dioxide, Silica, and Ammonia (BENJAMIN MOORE SUPER HIDE ZERO VOC INTERIOR LATEX) while using these chemicals in various phases of the manufactured housing door, interior, and exterior painting processes. The employer did not provide medical evaluations to employees required to use half-mask tight fitting respirators.
