29 CFR 1910.146(d)(5)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing conditions in the permit space to determine(a): Rail Cleaning Terminal: On or about May 10, 2019, and at times prior thereto, employees were exposed to chemical, fire, and explosion hazards while conducting the de-heeling process inside railcar tankers containing chemical commodity such as, but not limited to, natural gas condensate and sweet crude oil without the employer ensuring that atmospheric testing was conducted prior to entry.
