29 CFR 1926.800(j)(1)(ii)(A): The atmosphere in all underground work areas was not tested as often as necessary to ensure that the atmosphere contained at least 19.5 percent oxygen and no more than 22 percent oxygen: a) Culvert Install Site: On or about May 05, 2017 and at times prior, as the controlling employer, Knife River did not ensure that its sub-contractor, Coleman Construction Inc., protected their employees in that employees were exposed to acute illness, burns, impairment of ability to self-rescue, and incapacitation while removing soil, inspecting, flame cutting, tacking and welding inside of a 36 inch culvert. The controlling employer failed to ensure that Coleman Construction Inc., tested atmospheres to ensure that the atmosphere contained at least 19.5 percent oxygen and no more than 22 percent oxygen.
