29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. Excavation Site: On or about July 20, 2016, the Competent Person (as designated by the employer) did not take any precautions where there was evidence of a situation that could result in a possible cave-in or other hazardous condition. The soil was previously disturbed (twice) and very sandy. This condition exposed employees to cave-in hazards.
