Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to carbon monoxide in excess of the permissible exposure level: (a)On or December 9, 2003, in the apple packing house, an employee packing apples at tables #1, 3 and 7 was exposed to carbon monoxide at an 8 hour Time Weighted Average of approximately 131 ppm. Employee exposure was determined using post-exposure carboxyhemoglobin (COHB) measurements. (b)On or about December 9, 2003, in the apple packing house, an employee supervising the workers was exposed to carbon monoxide at an 8 hour Time Weighted Average of approximately 204 ppm. Employee exposure was determined using post-exposure carboxyhemoglobin (COHB) measurements. (c)On or about December 9, 2003, in the apple packing house, an employee working at the tables packing apples was exposed to carbon monoxide at an 8 hour Time Weighted Average of approximately 241 ppm. Employee exposure was determined using post- exposure carboxyhemoglobin (COHB) measurements. (d)On or about December 9, 2003, in the apple packing house, an employee packing apples was exposed to carbon monoxide at an 8 hour Time Weighted Average of approximately 170 ppm. Employee exposure was determined using post-exposure carboxyhemoglobin (COHB) measurements.
