29 CFR 1910.178(l)(3)(ii)(I): Other unique or potentially hazardous environmental conditions in the workplace that could affect safe operation. a) On or before 10/21/2024, the employer did not ensure that employees were trained on the unique hazard created when an excavation was dug between plant 4 and plant 6 that created a 10"-14" drop off between the excavation and the edge of the blacktop. Employees were not trained on ensuring that they were wearing their seatbelts due to the change in elevation between the excavation site and the walk-working surface of the blacktop, nor were employees trained on the potential hazard of driving the forklifts off the elevation and being exposed to a crushing hazard if the forklift landed on the employees. On 10/28/2024, an employee was crushed when the forklift tipped over into the excavation from the walk-working surface.
