29 CFR 1910.146(d)(4)(viii):Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that employees properly used rescue and emergency equipment needed to comply with 29 CFR 1910.146(d)(9). (a) Building 55, CP3 West Pit: On or about September 22, 2023, and times prior, a mechanical device was not available to retrieve two employees who were working in a vertical confined space pit approximately 11ft. 8in. deep. A rope was attached to the body harness and to a railing system around the confined space opening, exposing employees to asphyxiation and fire hazards. (b) Building 55, CP3 West Pit: On or about November 14, 2023, and times prior, a mechanical device was not available to retrieve an employee who was working in a vertical confined space pit approximately 11ft. 8in deep. A 50ft. nylon rope was attached to a body harness and to a railing system around the confined space opening, exposing the employee to asphyxiation and fire hazards.
