29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) Facility-Wide: On or about August 02, 2023, and at times prior thereto, employees were exposed to struck by hazards in that the employer allowed them to operate forklifts that were in unsafe operating conditions such as but not limited to the accelerator pedal being rigged with a piece of electrical wire to actuate the carburetor, electrical wiring having bare exposed connections and hanging down under the dashboard, the battery not being secured to the forklift and the parking brake was not functional.
