29 CFR 1926.1427(a): The employer did not ensure that each operator was trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer allowed the Liebherr 550 HC40, 20-ton tower crane to be operated by an operator that was not certified/licensed. This condition exposed subcontractor employees to fall, crushing, and struck-by hazards.
