29 CFR 1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck: a) On February 23, 2023, and prior to; forklift operators did not receive formal instruction in both a language and vocabulary employees could easily understand prior to operating forklifts. Forklifts are used to maneuver pallets of bagged potting and garden soils, bark, mulches and decorative stone from the bagging stations to staging areas on the interior and exterior of the production building.
