29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Spray Coating Area: On or about 11/16/2022, a written respiratory protection program was not established and/or implemented for employees, including but not limited to Spray Coaters, who are provided and required to wear respirators including, but not limited to, TruLine Breathe Free N95 respirators. Full shift air monitoring on an employee who sprays TCI Powder Coatings indicated the employee was exposed to an airborne concentration of titanium dioxide at an 8 hour time-weighted average of 21 milligrams per cubic meter which was 1.4 times the permissible exposure limit (PEL) of 15 milligrams per cubic meter. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
