29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations: (a) 157 West Jackson Street, New Holland PA, Interior of Milk Receiving Area, Silo 30c - On or about June 9, 2022, Silo 30c was marked as a permit required confined space; however, the employer did not identify in the program and implement procedures and practices for employees entering to perform maintenance work in Silo 30c. Employees were exposed to hazards to include caught in and engulfment hazards. (b) 158 West Jackson Street, New Holland PA, Mix Area, Blender #1 - On or about August 11, 2022, the employer did not implement the means, procedures, and practice necessary for safe entry of employees in to Blender #1 when spraying down the inside of the blender tank. Employees were exposed to hazards to include moving mechanical parts, caught in and engulfment hazards. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
