29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: Instance 1. On or about November 5, 2019, and at times prior thereto, employees walking on the stacked rock cages to form wall of the detention pond approximately 12 feet high without fall protection, exposing employees to a fall hazard. Instance 2. At the West end of excavation, on or about November 5, 2019, and at times prior thereto, employees were removing form wood from the concrete wall under construction while standing on the concrete culvert approximately 9 feet high without fall protection, exposing employees to a fall hazard. Instance 3. At the South end of excavation, on or about November 5, 2019, and at times prior thereto, an employee was removing form wood from the concrete culvert under construction while standing on top of the culvert approximately 12 feet high without fall protection, exposing employees to a fall hazard.
