29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including but not limited to, the requirements specified in 29 CFR 1910.146(d)(3)(i) through 29 CFR 1910.146(d)(3)(vi): Railcar Cleaning Terminals: On or about May 10, 2019, and at times prior thereto, employees were exposed to chemical, fire, and explosion hazards while conducting the de-heeling process inside railcar tankers containing chemical commodity such as, but not limited to, natural gas condensate and sweet crude oil without employer consistently ensuring employees followed the procedures of the written permit-required confined space program to eliminate the presence of recognized atmosphere hazards and sources of ignition.
