29 CFR 1910.140(d)(2)(ii): The employer did not ensure that personal fall arrest systems were rigged in such a manner that the employee cannot free fall more than 6 feet or contact a lower level. A free fall may be more than 6 feet provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds is not exceeded: (a) VerandaBlue, LLC at 2500 W 4th Ave, Denver, CO 80219: On and before August 24, 2018, the employer did not ensure that personal fall arrest systems were rigged in such a manner that the employee cannot free fall more than 6 feet or contact a lower level. Employees used a forklift to elevate themselves while standing on a pallet connected to the fork tines. The employees used a fall harness and a shock absorbing lanyard to connect to the forklift mast, and this shock absorbing lanyard did not protect employees from striking the floor. This condition exposed employees to fall hazards of up to 16 feet.
