29 CFR 1910.268(e): The employer did not ensure that personal protective equipment, i.e. head protection, protective devices and special tools for the employee were being used by the employee, nor did the employer provide a competent person to inspect these personal protective devices, tools and equipment before each day use to ascertain they are in good condition. a) 121 Cider Mill Road, Flemington, NJ 08822. The employee was working on and from a non-insulated truck mounted aerial lift in close proximity to energized overhead power lines while not wearing any head protection, i.e. hard hat. Incident occurred on or about 10/17/13. On or about 10/17/13 employee was working in close proximity to energized power lines while not wearing any head protection.
