29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress. (a) The employer does not require each employee to use a safe means of access during scaffold erection. This violation was most recently observed on May 31, 2013 at the worksite located at 1900 Northern Boulevard in Manhasset, NY where an employee erecting the north fabricated frame scaffold used the cross braces, by climbing on them, as a means of access and egress. To abate this violation, the employer must provide and ensure employees use a safe means of access when erecting its scaffolds; including the direction and supervision by competent persons it designates, to ensure that employees are erecting scaffolds properly.
