29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: a. Prep shop Cincinnati shear: Employees used a Cincinnati 12' shear to cut metal plate that had a guard 1-3/4" to 2" above the table and within 3" of the point of operation. The guard would not prevent employees from coming into contact with the hold downs and shear blade during operation of the shear, as determined on 5/30/13. Abatement Certification Required For This Item.
