29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) A ladder was not provided for employees to have quick egress from the excavation in case of emergency. The employer was excavating to 8 ft deep in the sidewalk to get to a sewer pipe. The employer encountered other utility (pipe) and rocks on one side resulting that the excavation was too narrow to fit a ladder and the employee in it at the same time. The employer failed to make the hole wider/ failed to provide a ladder. Location: 162 E 64th St, New York, N.Y. On or about 8/9/2012 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
