North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by hazard due to possible hook failure: a)facility, yard, boat hoist - the hooks used with the electric powered hoist had been welded to the spreader bar; were not provided with an inspection prior to the initial use; were not provided with frequent inspections; and were not provided with periodic inspections. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to construct and inspect the hooks in accordance with ASME B30.10-2005, sections 10- 1.1.2(c) Construction, 10-1.2.1.1(a) Initial Inspection, 10-1.2.1.2(a) Frequent Inspection, 10- 1.2.1.3(a) Periodic Inspection.
