Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to being struck by a refuse truck: a) Chatam Lane, Port Richey - On or about 5/25/07 - Refuse truck, license plate number N9181L, did not have an operating back up alarm. One feasible and acceptable method of abatement is to install or repair back up alarms to meet the requirements with ANSI Z245.1 - 2007 Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements, specifically by: an external audible warning signal device (back-up alarm) shall be provided on all motor vehicles(Paragraph 7.2.13.2 of ANSI Z254.1 - 2007).
