North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)Ecoht area where truck cabs exit the pretreatment booth - - 1 ton C/M chain hoist, used to remove a gear box, was attached to the roof I-beam by a chain that had not been tested to ensure it could support the weight of the hoist and associated gear box. NOTE:One acceptable and feasible method of abatement is to have the chain tested to ensure it can sustain the weight applied upon it.n
