Text For Citation: 01 Item/Group: 004 Hazard: CAVE IN

Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were expose to: Excavations, adjacent areas and protective systems were not inspected by a competent person prior to the start of work and as needed throughout the shift: Location: St Raymond's Cemetery On or About: 05/06/2000 On 05/06/2000 an inspection of an excavation (grave) that was to become a disinterment operation was not conducted by a competent person to ensure that the excavation did or did not need a protective system prior to employees entering the excavation. An employee was exposed to the hazard of cave-in while the employee was performing the disinterment, trapping him in the excavation. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO FOLLOW THE GUIDELINE SET FORTH IN 29 CFR 1926.651(k)(1): NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
