Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to hazard of being caught in the unguarded point of operation: (a)West Bank, Yard, Pacific 500 Hydraulic Press Brake - There was no barrier guard on the ends of the ram and there was no chain across the opening behind the press brake. Among other methods, one feasible and acceptable method to correct this hazard is to install a barrier guard at the ends of the press and install a chain across the back opening to prohibit employee entry into the space as outlined in American National Standard ANSI B11.3!, Safety Requirements for Construction, care and Use of Prower Press Brakes.
