North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility; staging - below the hook lifting device used on monorail system has not been load tested Reference: ANSI B30.20 - 1985; paragraph 20-1.4.2 (a) "Prior to initial use, all new, altered, modified, or repaired lifting devices should be tested and inspected by or under the direction of a qualified person and a written report must be furnished by such a person.." NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to conduct a load test on the below the hook lifting device.
