North Carolina General Statute 95-129(1) of the Occupationa Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)operating equipment that was unsafe. Using refuse collection truck # 84 with a defective latching link in the rear loader container latchup mechanism and a defective trunnion bar on the SCEO portable container (dumpster) at the time of the accident on July 30, 1997 at Hobgood Academy. ¿Ref ANSI Z245.1 -1992, paragraph 6.1d) " Among other methods, one feasible and acceptable abatement method to correct this hazard is repair or replace the defective components according to procedures recommended by the equipment manufacturer."XrPyPy&
