Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to permanent hearing loss due to lack of provision of training on effects of noise, hearing loss, and use of hearing protectors: At the establishment - In the following instances, the employees listed below were not provided training on the effects of noise, hearing loss, and the use of hearing protectors when such employees have occupational exposure to noise above 85 decibels averaged over and eight hour time period. a)1/5/99 -The employer failed to provide training to an employee on the Wash Crew with occupational noise exposure above 85 decibels as an 8 hr. TWA. b)1/5/99 -The employer failed to provide training to an employee on the Cleaning Crew with occupational noise exposure above 85 decibels as an 8 hr. TWA. c)1/5/99 -The employer failed to provide training to an employee on the Cleaning Crew with occupational noise exposure above 85 decibels as an 8 hr. TWA. Abatement Note: Provide training on the effects of noise and hearing loss and the use of hearing protectors to those employees with occupational exposure to noise exceeding 85 decibels as an eight hour time-weighted average (8 hour TWA).
