Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to internal injuries, fractures, and death due to falls down elevator shaft(s) and/or contact with moving elevator car(s): In the following instances elevator cars and shafts were not safely operated or guarded: a)Brooder Barn 3 - The hoist-way landing chain rails were not erected when the hoisting doors were opened. b)Brooder Barn 3 - The elevator car was not enclosed to prevent contact with the shear points in the hoist-way. c)Brooder Barn 3 - The elevator car safety device was not routinely checked. d)Brooder Barn 4 - The hoist-way landing chain rails were not erected when the hoisting doors were opened. e)Brooder Barn 4 - The elevator car was not enclosed to prevent contact with the shear points in the hoist-way. f)Brooder Barn 4 - The elevator car safety device was not routinely checked. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit employees from riding the elevators, annually inspect the elevator car safety device, and operate the elevators from outside the hoist-way using the pendant control.
