Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees in the refinery were exposed to the hazard potential of fires, explosions, and toxic material releases through the flare system in the event of loss of pilot flame due to the reliance on a single pilot igniter and the poorly maintained condition of the igniter. Among other methods, one feasible and acceptable method to correct this hazards is to establish a program or regular inspection, testing and maintenance of the igniter to assure its proper condition.
