Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of the powered excavating equipment damaging the pipeline causing an uncontrollable release of gasoline and creating a potential for fire/ explosion and contaminating the surrounding enviroment. Among other methods to correct this hazard, is the development and institution of a written procedure regarding the safe use of power equipment in the vicinity of petroleum pipeline facilities: Location: Valve 6R - Intersection of Victory Blvd. and South Cannon Ave. - Staten Island N.Y.
