Text For Citation: 01 Item/Group: 004 Hazard:
29 CFR 1926.1053(b)(17): Fixed ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, or corroded components, shall be withdrawn from service until repaired. The requirement to withdraw a defective ladder from service is satisfied if the ladder is either: (i) Immediately tagged with "Do Not Use" or similar language, ii) Marked in a manner that readily identifies it as defective; a) On or about May 16, 2024, the employer PCC Masonry, Inc. exposed employees to fall hazards of approximately 18 feet in that the fixed ladder installed on the east wall scaffold had structural defects to include but not limited to bent side rails.
