29 CFR 1926.62(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead: (a) On or about 05/01/2024 at the MTA-F line a 2.10-mile-long elevated steel structure from Kings Highway above McDonald Ave/Shell Road/West 6th Street and West 8th Street, abrasive blasters were eating at a table located inside a portable tent at Ave T. The table where employees were eating was found to contain 307.25 micrograms of lead. (b) On or about 05/01/2024 at the MTA-F line a 2.10-mile-long elevated steel structure from Kings Highway above McDonald Ave/Shell Road/West 6th Street and West 8th Street, abrasive blasters were transported from the containment to the shower trailer in a truck which had 564.77 micrograms of lead on the back seat where employees were sitting. The employer failed to maintain the truck back seat as free as practicable of accumulations of lead. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
